These terms and conditions (the "Terms and Conditions") govern the use of https://www.theatrebee.com (the "Site"). This Site is a blog for personal expression and creative exploration. This Site is not a business. The Owner of this site is Harshini Shanker, resident of the United Kingdom.

By using this Site, you indicate that you have read and understood these Terms and Conditions and agree to abide by them at all times.

You agree never to share any account information revealed to you without the explicit consent of the member-owner of that account. We reserve the right to suspend or terminate your account if you are using our Site illegally or if you violate these Terms and Conditions.

 

Sale of Goods
These Terms and Conditions govern the sale of goods available on our Site. When you click on the text 'Merch' in the Site's menu, you are taken to a third party platform, Spreadshop (whose parent company is Spreadshirt), where you can shop online for merchandise designed by the owners of this Site. The link to the shopping page is https://theatre-bee-store.myspreadshop.co.uk. As this Site is run by Spreadshop, it is governed by the Terms and Conditions as mentioned on that website, and not necessarily those mentioned here for https://www.theatrebee.com.

The following goods are available on our Spreadshop page:

  • Apparel;

  • Accessories;

  • Homeware; and

  • Other kinds of merchandise.

When you place an order, you enter a contract with Spreadshirt, who are under a legal duty to supply goods that match the description of the good(s) you order on their site. Spreadshirt handles printing, packing, shipping, invoicing, payments, returns, refunds, exchanges and everything else pertaining to your order. Therefore, you must consult the Terms and Conditions on the Spreadshirt page to understand the terms and conditions governing sale of product. 

 

The owners of this Site, Theatre Bee, do not have access to view your account on Spreadshop / Spreadshirt. We cannot view, modify, reject, cancel, exchange or refund your order after you complete your order on the Spreadshop / Spreadshirt platform. In fact, the identity of the purchaser is not revealed to us by Spreadshop. We only view aggregated sales statistics and have no access to view or influence order fulfillment.

All information, descriptions, or images that are provided about the goods including out-of-stock goods, as well as inventory, order fulfilment, billing and returns are handled by Spreadshirt. We are unable to comment on the specific Terms and Conditions that govern your transaction with Spreadshirt. Further, we are not legally bound by such information, descriptions, or images as we cannot guarantee the accuracy of all goods we provide. You agree to purchase goods from our Spreadshirt at your own risk.

You agree that it is your responsibility to monitor your payment instrument to verify receipt of any refund.

For your convenience, we summarise below the Terms and Conditions pertaining to shipping, delivery, right to cancel, return and exchange and refunds as stated on the Spreadshop / Spreadshirt platform. This summary should not be treated as a binding or final set of statements that govern your transaction with Spreadshirt. For the most updated Terms and Conditions you must refer to the Spreadshop / Spreadshirt website and your checkout page when you complete the order. The information provided on this Site is not guaranteed to be the latest and most accurate as Spreadshop / Spreadshirt reserve the right to change their Terms and Conditions at any time.

Shipping and Delivery

When you purchase our designs from Spreadshop / Spreadshirt platform, the goods will be delivered through one of the following methods by them:

  • Standard delivery by post or courier service depending on customer address. Fulfilled by Spreadshirt using third party postal or courier services including but not limited to Royal Mail (UK), DHL, UPS, etc. Products shipped from Germany. Delivery takes 5-7 business days but may take longer depending on customer address; or

  • Express delivery available for fast delivery at a charge. Fulfilled by Spreadshirt using third party postal or courier services including but not limited to Royal Mail (UK), DHL, UPS, etc.

Spreadshop is known to make delivery take place as soon as reasonably possible, depending on the delivery method selected. Delivery times may vary due to unforseen circumstances. Please note that delivery times do not include weekends and bank holidays. You will be required to pay delivery charges in addition to the price for the goods you purchase. We are unable to take any responsibility for the delivery of your goods, which is not within our control at all.

If you purchase goods featuring our designs on our Spreadshirt page for delivery to a destination outside the United Kingdom your purchase may be subject to import duties and taxes applied by the destination country. You are responsible for paying any such duties or taxes. Please contact your local customs office for more information before making a purchase. We are not responsible for the payment of any such duties or taxes and are not liable for any failure by you to pay them.

You are required to provide a complete and accurate delivery address, including the name of the recipient. We are not liable for the delivery of your goods to the wrong address or wrong person as a result of you providing us with inaccurate or incomplete information.

Right to Cancel and Receive Reimbursement
If you are a customer living in the United Kingdom or the Eurpoean Union you have the right to cancel your contract to purchase goods from Spreadshirt within 14 days without giving notice. The cancellation period:

  • Will end 14 days from when you receive, or someone you nominate receives, the goods when you purchased good(s) in one order that are all delivered together;

  • Will end 14 days from when you receive, or someone you nominate receives, the last good when you purchased goods in one order that are delivered separately; or

  • Will end 14 days from when you receive, or someone you nominate receives, the first good when you purchased goods that will be regularly delivered during a defined period of time.

To exercise your right to cancel you must inform Spreadshirt of your decision to cancel within the cancellation period. The owners of https://www.theatrebee.com do not have any control over this process or its outcome. For your information, please note that by law, the right to cancel does not apply to:

  • Goods or services, other than the supply of water, gas, electricity, or district heating, where the price depends upon fluctuations in the financial market that we cannot control and that may occur during the cancellation period; 

  • Custom or personalised goods; 

  • Goods that will deteriorate or expire rapidly; 

  • Alcoholic beverages where the price has been agreed upon at the time of purchase, delivery of them can only take place after 30 days, and their value is dependent on fluctuations in the market that we cannot control; and

  • Newspapers, magazines, or periodicals, except for subscriptions to such publications.

 

Effects of Cancellation
If you cancel your contract with Spreadshop / Spreadshirt and goods have already been sent to you, then you must return the goods as soon as possible to the Spreadshop / Spreadshirt address after informing them of your decision to cancel. You will be responsible for the cost of returning the goods. We will not be responsible for any damage or loss to the goods that occurs, including while the goods are in transit. We are also not responsible for your communication with Spreadshop / Spreadshirt and cannot mediate for you.

If you cancel your contract with Spreadshirt, we are not liable to reimburse you anything and your transaction will be with Spreadshirt alone. Spreadshirt may be reasonably expected to reimburse to you all payments they received from you under the contract, including the costs of delivery, except for any supplementary delivery charges resulting from your choice of a delivery type other than the least expensive type of standard delivery that they offer; however you must consult their Terms and Conditions to verify this. Please note that they are permitted by law to reduce your reimbursement to reflect any reduction in the value of the goods that was caused by handling other than what is necessary to establish the nature, characteristics, and functioning of the goods. 

The owners of Theatre Bee cannot handle your return and reimbursement for you, and cannot transact with Spreadshop / â€‹Spreadshirt on your behalf, although we may talk to them, follow up with them, or make a special request to them to process your return if you request us to do so. However, we cannot take any responsibility for how they respond, and you must refer to their Terms and Conditions and satisfy yourself of the terms of your contract with them. Any additional assistance we may provide you in communicating with them is out of goodwill and not due to any legal obligation to do so, and therefore we are not legally liable for the communication or its outcome.

Refunds for Goods
Please note that we have no access or control over your return process, which is entirely handled by Spreadshirt, and so you must check their Terms and Conditions. However, as legally non-binding guidance, we are able to tell you that to the best of our knowledge, refund requests can be made within 30 days after receipt of your goods from Spreadshirt, and refund requests for goods sold on our Spreadshirt Site can be made for any of the following reasons:

  • Good is broken;

  • Good does not match description;

  • Good is the wrong size;

  • Purchaser changed their mind;

  • Good does not meet the purchaser's expectations; or

  • Any other reason, for example the good is no longer needed.

Returns
Returns can be made by mail. To return a good by mail, follow the following procedure: Open your delivery confirmation or your Spreadshirt account. Click on “Returns”. Select a reason for your return and choose a Return option. Return options depend on your specific location, but in general, you will be able to pack your goods, attach a return label, go to your nearest post office and mail your return. Your return is usually processed within 7 business days. If your order value was €40 or more, Spreadshirt will cover the return costs. Please always contact our service team before returning anything. In many cases, we find a solution that avoids sending packages back and forth unnecessarily. It’s for the sake of your time and the environment.

 

Consumer Protection Law
Where the Sale of Goods Act 1979, the Consumer Rights Act 2015, or any other consumer protection legislation in your jurisdiction applies and cannot be excluded, these Terms and Conditions will not limit your legal rights and remedies under that legislation. These Terms and Conditions will be read subject to the mandatory provisions of that legislation. If there is a conflict between these Terms and Conditions and that legislation, the mandatory provisions of the legislation will apply.

 

Links to Other Websites
Our Site contains links to third party websites or services that we do not own or control. We are not responsible for the content, policies, or practices of any third party website or service linked to on our Site. It is your responsibility to read the terms and conditions and privacy policies of these third party websites before using these sites.

Limitation of Liability
This Site's owners, directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Site.

 

Indemnity

Applicable Law
These Terms and Conditions are governed by the laws of the Country of England.

 

Severability
If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Site and the way we expect users to behave on our Site.
